Terms & Conditions.

1. Quotations and bookings
Quotations are subject to availability and valid for the stated period. A booking is confirmed when the required deposit is received unless agreed otherwise in writing. Equipment, crew and dates are not reserved indefinitely while a quotation remains unconfirmed. Quotations cover only the stated services, equipment, crew, operating times and scope; additions may incur charges.
2. Deposits and payment
Deposits are non-refundable, subject to applicable South African law. Full payment is due no later than seven days before the event unless agreed otherwise in writing. Additional charges incurred during or after the event may be invoiced separately.
3. Cancellations
Cancellations must be in writing. For cancellation within 10 days of an event, the client or organiser may remain liable for the full invoiced amount, subject to applicable law and costs reasonably avoided. Deposits remain non-refundable except where required by law or agreed in writing.
4. Postponements / date changes
Date changes are subject to JD Productions’ availability. Payments do not guarantee availability on another date. Where practical, payments may at JD Productions’ discretion and subject to law transfer to a rescheduled event. Additional costs caused by a change may be charged.
5. Event requirement changes
Quotations rely on client information. Changes to venue, guest numbers, programme, event times or technical scope may require a revised quotation. Last-minute additions cannot be guaranteed.
6. Setup / access / breakdown
JD Productions requires sufficient setup and breakdown time; the organiser must ensure venue access. JD Productions is not responsible for delays caused directly by inadequate access. Where insufficient breakdown time causes a lock-in or later return, overtime, labour and/or travel charges may apply.
7. Overtime
Unless another rate is stated, additional hours outside agreed event time are charged at R500.00 per hour. Overtime must be approved by the organiser or authorised representative, not ordinary guests, and remains subject to crew availability, venue restrictions and safe operating conditions.
8. Venue / electrical requirements
The organiser must provide adequate safe electrical power unless alternative power is included. JD Productions is not responsible for interruption or failure caused directly by inadequate venue power, external failure or unsafe infrastructure beyond reasonable control, and may refuse an unsafe supply.
9. Weather / outdoor events
Outdoor use must be disclosed in advance and suitable weather protection provided. JD Productions may stop, delay, relocate, disconnect or remove equipment where conditions create a reasonable safety risk. Safety decisions by its technical personnel cannot be overridden by attendees.
10. Force majeure
Neither party is responsible for failure or delay caused by circumstances genuinely outside reasonable control, subject to applicable law, including severe weather, disasters, fire, flooding, civil disturbance, restrictions, venue closure or widespread infrastructure failure. Both parties should reasonably minimise impact and consider alternatives.
11. Equipment damage / interference
Unauthorised people may not move, operate, disconnect or interfere with equipment or restricted technical areas. The organiser may be responsible for reasonable repair or replacement costs for loss or damage caused by negligent, reckless, deliberate or unauthorised client, guest or controlled-person actions, subject to law. Normal wear and unrelated failure are excluded.
12. Health and safety
JD Productions may refuse, suspend or discontinue activity its responsible technician reasonably considers unsafe. No client instruction requires unlawful or reasonably unsafe work.
13. Permits / approvals
Unless included in the quotation, the organiser is responsible for venue permissions and event approvals, including sound levels, access, rigging, staging, filming, photography, drone operation and temporary structures.
14. Third-party suppliers
JD Productions may use suitable technicians, freelancers, subcontractors or suppliers where reasonably necessary and remains responsible for its own obligations. It is not responsible for suppliers appointed directly by a client.
15. Technical failures
JD Productions takes reasonable precautions for reliable service, but uninterrupted live production cannot be guaranteed in every circumstance. Where a problem occurs, it will reasonably restore service, provide available alternatives or minimise disruption. Nothing excludes liability that cannot legally be excluded.
16. Photography / videography / POPIA
Photography and videography are conducted subject to applicable South African privacy and data-protection requirements, including POPIA where applicable. The organiser must notify specific privacy, confidentiality or filming restrictions. Attendees should be informed where appropriate, and required consent obtained.
17. Portfolio / promotional use
Unless agreed otherwise in writing, JD Productions may use lawfully captured photographs and video for portfolio, website, showreel, social media and promotion, subject to privacy law and confidentiality requirements. Clients needing confidentiality must notify JD Productions in writing; specific agreements take precedence.
18. Raw footage / intellectual property
Unless agreed otherwise, raw footage, project files, editing timelines and working production files remain JD Productions property. Final delivery does not automatically include raw or editable files; these are supplied only if included or separately agreed.
19. Client-supplied content
The client is responsible for lawful use of supplied logos, music, photographs, videos, graphics, presentations and other third-party material. Licensing, broadcast rights and permissions may be defined in the quotation or project agreement.
20. Content delivery
Edited photography/video delivery dates are estimates unless guaranteed in writing. Timelines may depend on scope, feedback and revisions; revisions outside agreed scope may be quoted separately.
21. Travel / additional expenses
Travel, accommodation, tolls, parking, permits, courier charges and other production expenses may be charged where stated. Material unforeseen expenses should, where practical, be discussed before incurring them.
22. Client / programme delays
JD Productions is not responsible for delays caused by client, venue, performers, guests or independently appointed suppliers. Delays extending agreed operating or staffing times may attract overtime or labour charges.
23. Wedding and commercial video agreements
Wedding videography packages and commercial productions may have separate service-specific agreements. Those agreements take precedence where they conflict with these General Terms.
24. Limitation of liability
Nothing here excludes or limits liability that cannot lawfully be excluded or limited in South Africa. Subject to law, JD Productions is not responsible for indirect or consequential loss arising from circumstances outside reasonable control.
25. Acceptance
Clients must have reasonable access to these Terms before booking. Acceptance of a quotation, deposit/invoice payment, signing an agreement or explicit electronic acceptance may constitute acceptance of the applicable quotation and these Terms, subject to law. Separate written agreements should be read together.
